Ben Kapur Photography Terms and Conditions 2026

1. Booking and Payment:

Confirmation of services requires a written agreement from the client to confirm time,

date and deliverables. This can be in the form of an email or a signed contract. The

photographer reserves the right to request a 50% non-refundable deposit to secure the

shoot. Payment terms are 14 days from date of invoice.

Full payment is due within 14 days of Deliverables, despite ongoing amendments

2. Cancellation and Refunds:

In the event of cancellation by the client, any deposit is non-refundable.

If cancellation occurs within 7 days before the shoot, a percentage of the total fee may

be charged. If rescheduling occurs within 7 days before the shoot, an additional fee may

be charged and a replacement date will be offered.

The photographer/videographer reserves the right to cancel due to unforeseen

circumstances or illness, and will provide a full refund or provide a replacement service of

equal quality.

3. Services Provided:

Clearly outline the services included in the package (e.g., hours of coverage, number of

photographers/videographers, edited images/videos).

Specify any additional services available (e.g. extra hours, additional photographer, extra

deliverables) and their associated costs.

4. Creative Control and Output:

The photographer/videographer holds creative control over the images/videos produced.

The client will receive a specified number of edited images/videos within a certain

timeframe after the event.

Raw/unedited files may or may not be provided, based on the agreement. If agreed,

access to RAW photos/videos will be charged at an agreed rate

5. Revisions:

The quoted fee includes one round of minimal revisions to the delivered content. Additional

revisions or changes requested beyond the initial round, including but not limited to

alterations in editing style, music selection, or requested re-edits, may incur additional

charges based on the time required. Any major changes to the agreed deliverables after

completion of the first edit will be treated as additional work and quoted separately.

6. Client Cooperation:

The client agrees to provide necessary cooperation, including but not limited to, timely

arrival at scheduled locations and communication for necessary information.

It’s essential to provide a detailed list of desired shots which the client wishes to capture.

Ongoing Cooperation is essential until project completion, and outstanding payment is due

And will be settled in full if Photographer has requested

7. Location and Access:

The client is responsible for obtaining necessary permissions and access to locations for

photography/videography.

The photographer/videographer is not liable for limitations imposed by the location that

may impact the service provided.

8. Copyright and Usage Rights:

The photographer/videographer retains the copyright to all images/videos and reserves

the right to use them for promotional purposes unless otherwise agreed upon.

All quotes include a usage license for the named client to use the final content for

promotional purposes, such as but not limited to social media, website, and other

marketing materials. A full license agreement outlining usage rights can be provided upon

request.

9. Liability and Indemnity:

The photographer/videographer is not liable for circumstances beyond their control that

may hinder or prevent services provided.10. Delivery Schedule:

The photographer/videographer will provide an estimated timeline for delivery of edited

images/videos after the shoot. Communicate the method of delivery (online gallery,

download links, etc.) and any associated details.

11. Travel & Expenses:

The photographer/videographer reserves the right to add travel, accommodation and

food expenses onto the invoice. Mileage is charged at £0.55 a mile.

12. File Storage:

Final deliverables will be stored for a minimum of 2 years, while raw content is stored for

a minimum of one year post-delivery; beyond these terms, files are subject to deletion

unless a storage extension is purchased or agreed otherwise.
